Who You Are Contracting With
These Terms & Conditions are a legal agreement between you and Etchture Co LLC, a limited liability company trading as “Etchture Co” (“we”, “us”, “our”). Etchture Co LLC is the seller of all products and services offered on etchtureco.com. “Etchture Co” is the customer-facing brand name of Etchture Co LLC.
Acceptance of Terms
By accessing, browsing, or purchasing from this website, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of the site and services. If you are entering into these terms on behalf of an organization, you confirm you have authority to bind it; if purchasing as an individual, you confirm you are of legal age.
Products
Etchture Co LLC sells downloadable digital website templates and related digital resources, delivered electronically. Customers are responsible for downloading, storing, and backing up their files, and for keeping account credentials confidential.
License to Use
Purchase grants a limited, non-exclusive, non-transferable license to use the template files as outlined on our Licensing page. Ownership of the original design, software, documentation, and all other intellectual property remains with Etchture Co LLC.
Acceptable Use
You must not misuse the site or the products. In particular, you must not:
- Use the site or products for any unlawful purpose
- Engage in fraud, spam, or misrepresentation
- Infringe the intellectual property rights of Etchture Co LLC or any third party
- Introduce malware, probe, scan, scrape, or otherwise interfere with the security or integrity of the site
- Resell, redistribute, sublicense, publicly share, upload to marketplaces, or repackage template files
- Reverse engineer or circumvent technical limits or license controls
Payments and Billing
Purchases are sold directly by Etchture Co LLC. Payments are processed securely by Stripe, our payment processor. Customer service, order questions, and refund requests are handled by Etchture Co LLC at info@etchtureco.com.
Card details are collected and processed by Stripe under Stripe’s terms. Etchture Co LLC does not store full payment card information.
Refunds
We offer a 30-day money-back guarantee. Full details are set out on our Refund Policy page.
Service Level
We do not guarantee that the site or products will be uninterrupted, error-free, or free of defects. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Compatibility
Customers are responsible for ensuring compatibility with their chosen hosting environment, platform version, and any third-party plugins or integrations.
Suspension and Termination
Etchture Co LLC may suspend or terminate your access to the site, your account, or downloads in the event of: material breach of these terms, non-payment or chargeback, suspected fraud or security risk, or repeated or serious policy violations. On termination, license rights end and access to files may be withdrawn.
Intellectual Property
All site content, branding, copy, images, and code are owned by Etchture Co LLC unless otherwise credited. Unauthorized use is prohibited.
No Income Guarantees
Our templates and resources are design and educational tools. No guarantee is made regarding income, traffic, sales, or business outcomes.
Limitation of Liability
To the fullest extent permitted by law, Etchture Co LLC shall not be liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
Governing Law
These terms are governed by the laws of the United States and the state in which Etchture Co LLC is registered, without regard to conflict-of-law rules.
Changes to These Terms
We may update these terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
